Section 4
Establishment and Formation of Tribunals
(1) The Government of Nepal may publish a notice in the Nepal Gazette and establish a Debt Recovery Tribunal as required for the initiation and settlement of cases related to debt recovery of banks and financial institutions. (3) The Tribunal shall have the following members: (a) Law Member, (b) Banking Member, and (c) Accounting Member. (3a) If the workload of the Tribunal increases, the Government of Nepal may increase the number of members. (3b) Subsection (3a) If members are added, the tribunal will have benches as needed and each bench will have law, banking and accounting members. (3c) If there is more than one bench in the tribunal, the chairman will form a bench and determine the case. (4) The chairman of the tribunal will be a law member and more than one. In the case of a law member, the law member who was previously appointed to the tribunal, if such law member is absent, another law member and if there is no such law member, or if the husband is absent, the banking member who was appointed earlier and if he is also absent, the banking member who is present will be the chairman of the tribunal. (5) Regardless of what is written elsewhere in the section, the Government of Nepal may, by publishing a notice in the Nepal Gazette, add to the territorial jurisdiction of the tribunal and grant the right to initiate and dispose of debt recovery related cases.
